First Class Bus Tours Service Agreement
1. Service Description and Itinerary
The chartering party agrees to provide a detailed itinerary for the trip. The total cost is based on the information provided in the original conversation (quote) and is subject to change based on itinerary alterations.
2. Costs and Additional Fees
Rates include applicable taxes and are based on vehicle availability. The total cost does not include bus parking fees or the bus driver’s accommodation, which are to be covered by the chartering party. Parking fees and tolls incurred throughout the trip are the client's responsibility and are not included in the initially quoted total. These costs must be covered by the customer. Any additional hours required beyond the scheduled time will be charged at $90.00 per hour.
3. Payment Terms
Full payment must be made 30 days before the departure date or no later than the payment due date as specified in this contract. If the full balance is not paid by this due date, the contract is subject to termination. All deposits made are non-refundable, non-transferable, and no credit will be applied for them. Payments are accepted through credit or debit cards. However, all credit and debit card transactions are subject to an additional 2.9% processing fee, with Chase Bank handling these payments. To avoid processing fees, payments can be made via mailed checks, cashier checks, or money orders to: 4110 North Patterson Ave, Winston-Salem, NC 27217. Confirmation of the trip must be made via call or email at least one day in advance.
4. Payment Deadline and Late Fees
Full payment is due before services are rendered. Failure to make full payment by the established date may result in an additional late fee and/or termination of the service without refunds of any monies paid, including deposits and scheduled payments. Any payments received after the due date will be subject to a late fee of 0.05% of the total service agreement cost. Furthermore, late payments must be made in cash or via certified funds. FCBT reserves the right to refuse any trip paid after the balance due date has expired. Deposits will not be refunded if paid. The remaining balance is not refundable in case of customer cancellation. These funds are transferable for up to 30 days based on bus availability. After 30 days, any credit applied will expire and not be honored by FCBT. The remaining balance amount is determined by the deposit paid and any unpaid funds received by FCBT.
5. Trip Cancellation Policy
First Class Tours reserves the right to cancel trips due to unforeseen circumstances (e.g., inclement weather, mechanical failure) with full reimbursement. No additional or substitute transportation will be provided in such cases. All coupons, discounts, gift cards, and certificates are non-redeemable with no cash value. Cancellations are non-refundable.
6. Fuel Price Condition
The quoted prices remain valid as long as fuel costs do not surpass $4.95 per gallon. Should fuel prices rise above this threshold, the prices are subject to change.
7. Driver Accommodation and Working Hours
Drivers must be provided with individual rooms, the cost of which is not included in the total service cost. Driving time is limited to a maximum of 10 hours per day within a total of 14 on-duty hours.The itinerary may be adjusted if the driving time exceeds the allotted hours or if on-duty hours are surpassed. If your group departs later than the scheduled time, this delay may alter the schedule for subsequent stops. This is due to the regulated hours available for the driver. Therefore, it's important to adhere to both your planned and actual departure times.
8. Bus Maintenance and Passenger Conduct
To avoid incurring a $100.00 cleaning fee, the bus should be left clean after the trip. This fee is waived if the bus is maintained in a clean condition post-trip. The company assumes no responsibility for valuables left on or off the bus, except for those items directly entrusted to the driver. The chartering party is responsible for passenger mishaps, including vandalism, property damage, and bodily fluids. This is a non-smoking facility. Open cups without lids are prohibited on the bus.
9. Gratuity and Rate Adjustments
Gratuity for drivers is not included in the trip cost but is greatly appreciated. Please pay tips directly to the driver(s). Average driver's tip suggestion: $3.00 per person based on the coach size, e.g., for a 56-person coach, the tip would be $168.00 (56 x $3.00). The rates and bus sizes (chartered coach) are subject to revision by First Class Bus Tours (FCBT), who reserve the right to adjust rates as previously quoted, whether communicated via text, email, verbally, or in writing, for contract preparation.
10. Travel Insurance and Refunds
Passengers are required to obtain travel insurance for cruise journeys or refundable tickets for events to mitigate cancellation or delay issues. Rates and bus sizes are subject to adjustment by First Class Bus Tours, and the company reserves the right to match quoted rates.
11. Cruise Travel Itinerary and Meal Stops
An itinerary is required for cruise travel, including breakfast stops. One-hour sit-down dinners on return trips from cruises are not feasible without incurring additional costs for a second driver to relay the bus, typically an extra $350.00. Returning from cruises mandates stop-and-go meals. For 31-passenger mini bus use in cruises, luggage is limited to one storage and one carry-on per person due to limited space.
12. Additional Fees and Conditions for Cruises
Tolls, hotel accommodations, parking, and the driver's city fees are the charter party's responsibility. For cruises, fees including driver’s room, parking, and tolls are covered unless otherwise stated. Extra load and departure times are provided for the convenience of First-Class tours for cruises. The driver's on-duty time cannot exceed 14 hours per day.
13. Service Disruptions and Additional Services
First Class Tours is not liable for inconveniences caused by late arrivals, departures, or schedule changes by the chartered party. Delays due to sickness, machinery breakdown, weather, or other uncontrollable factors are not the responsibility of First Class Tours. Efforts will be made to ensure destination arrival, either by hiring another charter or repairing the bus. Additional services beyond the initial contract will be charged to the chartering party. In case of breakdown, attempts will be made for timely repair or backup transportation; however, no refunds or credits are provided for mechanical breakdowns. For additional days beyond the contract, a fee of $350.00 per day plus driver’s pay rate and hotel fees applies.
14. Late Arrivals of Ships or Planes
First Class Tours is not responsible for delays due to late ship or plane arrivals.
15. Miscellaneous
Buses and vehicles are not medically equipped. Buses are equipped with complimentary Wi-Fi and cellular phone chargers.
Cancellations are non refundable. Tolls, Hotel accommodations parking, city fees cab fee for driver for parking is to be paid by the charter party using the service of First Class Tours if applicable as contract. Prices are subject to change based on fuel cost exceeding $4.95 per gallon noted. On cruises all fees included unless noted in contract, drivers room inclusive in contract and parking and tolls for cruises only unless noted. We at First Class Tours allow for extra load and departure times for the convenience of First-Class tours for cruises. We apologize for any inconvenience, but we need ample time for scheduling, traffic, and miscellaneous. This is part of on time duty for drivers which can’t exceed 14 hours per day. First Class Tours is not responsible for any inconvenience caused by late arrivals and or departure of passengers or change of schedule by the chartered party. First Class Tours will not be responsible for any delays caused due to sickness, machinery breakdown, weather or any cause beyond the control of First Class Tours. First Class Tours will make all efforts to get the chartered party to the destination, by hiring another charter or getting the bus fixed to make the trip successful. If chartered party desires additional services other than those specified in the initial contract, the chartered party agrees to pay for the additional services. This is a nonsmoking facility. In the event a breakdown occurs First Class will attempt to repair break down in timely manner or send for backup transportation and no money or credit will be given for mechanical breakdowns. Additional break down back up service will be provided at the expense of FCBT. If group needs additional days past contract, additional fees of $350.00 per day plus drivers pay rate and hotel fees applies and must be paid before departure back to original destination. FCT is not responsible for late ships or planes coming in a day late.
